The Current Legal Status of Kratom in the United States
Currently, kratom is not a federally controlled substance in the United States. Although the Drug Enforcement Agency (DEA) attempted to outlaw kratom in 2016, advocates pushed back. They rallied the public to support access to kratom, gathering over 100,000 signatures on a White House petition as well as the support of 50 members of Congress to successfully delay the DEA’s proposed ban. As of 2024, kratom is not categorized as an illegal drug by the federal government.
However, some states and local governments have passed their own legislation to ban or limit access to kratom. Kratom is prohibited in Alabama, Arkansas, Indiana, Tennessee, Vermont, and Wisconsin. Other states have anti-kratom bills currently pending. Additionally, some cities or counties have banned kratom even in places where it is still legal at the state level. Kratom Advocacy Groups

The American Kratom Protectors
The American Kratom Protectors is a national grassroots organization that works to stop the spread of misinformation about kratom and promote the passage of the Federal Kratom Consumer Protection Act. They operate on the local level within state Congressional districts, with regional chapters that connect kratom enthusiasts with ways to get involved in advocacy. Truth In Labeling
Without federal regulations, there are no nationwide manufacturing standards or safety requirements that the kratom industry must follow. Unfortunately, this means that some kratom vendors use unscrupulous business practices. Often, they exaggerate the benefits of kratom or make health claims that aren’t currently supported by scientific research. These vendors make it difficult for users, as well as legitimate, trustworthy sellers — without regulations, some people may not know who to trust when buying kratom.
Truth In Labeling is an advocacy campaign started by the American Kratom Association, which encourages kratom suppliers to use transparency in their marketing while helping consumers report suspicious businesses. American Kratom Association GMP Standards
The American Kratom Association (AKA) has also spearheaded industry-wide standards for sourcing, testing, and manufacturing kratom products like capsules, powders, and tinctures. GMP stands for Good Manufacturing Practices and can refer to any protocols involved in the processing of kratom, from farming to packaging and labeling.
After establishing these GMP guidelines, the AKA’s program offers a verification certificate to eligible vendors. Vendors can submit for the AKA GMP seal and then undergo inspection from independent auditors.
